Terms of Use
The rules for accessing and using Backfetch, LLC’s website, dashboard and web data APIs.
Version · English
1. Your agreement with Backfetch, LLC
Backfetch, LLC (“BackFetch”, “we”, “us”) provides the BackFetch website, account dashboard and available web data APIs (the “Services”). These Terms of Use govern your access to the Services. Our Terms of Sale additionally govern credit purchases, billable requests and automatic recharge. A separately signed agreement prevails where it expressly changes these terms.
When you check the acceptance box, you agree to these terms for yourself or for the organization you are authorized to represent. You must be at least 18 and legally able to enter into this agreement. If you do not agree, do not create an account or continue signing in. Accepting these terms does not subscribe you to marketing messages.
2. Accounts and workspaces
Provide accurate account information and keep your email address current. Protect passwords, recovery codes, API keys and identity-provider access. Use individual accounts and workspace invitations to give teammates access, rather than sharing personal sign-in credentials. Tell us promptly if you suspect unauthorized activity.
Workspace owners control membership and permissions. Only grant billing or administrative access to people authorized to act for your organization. You are responsible for requests made through credentials you issue and for the actions of people you authorize, subject to any responsibility we have under applicable law.
3. What the Services provide
BackFetch helps you retrieve and process public web content through the products enabled for your workspace. Documentation, dashboard settings and any agreed order describe the available features, supported request types and limits. Roadmap items, demonstrations and sample SDK snippets are illustrative unless explicitly made available as a production feature.
You may integrate the Services into your applications within the limits that apply to your workspace. This permission does not transfer ownership of BackFetch software, branding or infrastructure. Do not resell access to our infrastructure, distribute shared API credentials or imply our endorsement without our written agreement. Rights granted by mandatory law or a separate open-source license remain unaffected.
4. Acceptable use
Choose collection targets and uses that are lawful. Assess the rules applicable to each source, including access restrictions, privacy obligations and intellectual-property rights. Public visibility alone does not establish a right to copy, republish, profile people or use content to train a model.
Do not use BackFetch to access private accounts or restricted information without authorization; steal credentials; distribute malicious software; overwhelm a website or network; send spam; commit payment or advertising fraud; impersonate others; or facilitate harassment or unlawful surveillance. Do not use the Services to collect sensitive personal information unlawfully or to infringe the rights of children or other individuals.
Do not bypass BackFetch’s billing controls, quotas, account suspensions or access restrictions. We may investigate suspected misuse, request an explanation of a use case and limit requests that threaten the Services or third parties. You must cooperate with reasonable requests needed to resolve that misuse.
5. Your inputs and collected content
You retain the rights you already hold in inputs you submit. You authorize us and the service providers involved in delivering a request to process those inputs to operate, secure and support the Services. Only submit information you are entitled to provide, and avoid including secrets or unnecessary personal information in URLs, queries and request bodies.
Retrieved content may belong to its original publisher or another rights holder. Our delivery of a response does not assign those rights or give a warranty that a particular downstream use is permitted. You are responsible for assessing and obtaining the permissions your use requires.
The Privacy Policy explains account and operational data handling. If your intended use requires BackFetch to process personal data on your behalf under a data processing agreement, arrange that agreement with us before that processing begins. These terms alone do not replace a required data processing agreement.
6. Confidential information
Each party will protect nonpublic business or technical information received from the other that is identified as confidential or should reasonably be understood to be confidential. Use it only to carry out this agreement and share it only with people or service providers who need it for that purpose and are bound to protect it. This does not restrict independently developed information, information lawfully obtained elsewhere, public information or disclosures required by law.
7. Availability and results
Websites and search engines can change, block requests, remove pages or return incomplete information. Results may vary by time, location and request settings. Verify outputs before relying on them. BackFetch does not promise that every target is reachable or that every result is accurate, complete or current.
We may maintain or update the Services and introduce reasonable operational limits. Any uptime commitment or service-credit remedy must be expressly stated in a separate agreement. To the extent permitted by law, the Services are provided on an “as available” basis, without implied warranties of merchantability, fitness for a particular purpose or non-infringement.
8. Suspension and closing an account
We may restrict or suspend access to address a material breach, unpaid charges, fraud, a security incident or a legal requirement. Where practical and lawful, we will explain the reason and give you an opportunity to resolve it. Urgent action may be necessary to protect users or third parties.
You may stop using BackFetch at any time. Disable automatic recharge, revoke integrations and arrange ownership of shared workspaces before closing your account. Closing a user account does not necessarily close a workspace belonging to other members. Amounts already incurred and provisions that logically survive termination remain applicable. The Terms of Sale govern remaining credits and payment questions.
9. Responsibility and limits
Each party remains responsible for its own conduct. To the extent permitted by applicable law, neither party is liable to the other for indirect or consequential losses, including lost profits, lost business opportunities or loss arising from reliance on third-party content.
To the extent permitted by law, BackFetch’s aggregate liability arising from the Services is limited to the greater of USD 100 or the fees you paid BackFetch for the affected Services in the twelve months before the event giving rise to the claim. This limit does not exclude fraud, willful misconduct, or liability and remedies that applicable law does not allow us to limit. Your obligation to pay valid charges remains due.
10. Changes and general provisions
We identify each edition by its version date. Material changes will be communicated through the Services or your account email before they take effect, except where a legal or urgent security requirement requires earlier action. We may ask you to accept the revised terms before further access. Changes do not retroactively alter completed purchases.
If one provision cannot be enforced, the remaining provisions continue to apply. Failure to enforce a provision immediately does not waive it. Neither these terms nor the Terms of Sale remove mandatory rights that apply to you, including consumer rights where relevant. Notices and questions should be addressed to the contracting entity, Backfetch, LLC.
